Terms of Service

VelvetGig is an online marketplace that helps clients discover independent professionals, called agents, by city and date. VelvetGig provides the directory, search tools, profile pages, account tools, and contact handoff. VelvetGig is not a staffing agency, employer, talent representative, booking agent, or party to an engagement between a client and an agent.

Any service, price, schedule, deliverable, payment, cancellation, and other engagement terms are agreed directly between the client and the agent. VelvetGig does not take a cut of those arrangements and does not process payment for them.

By using VelvetGig, creating an account, publishing a profile, or contacting an agent, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be legally able to enter into a binding agreement in your location. You are responsible for your account and for activity carried out through it.

You may sign in with an available social identity provider or another sign-in method offered by the service. You must provide information that is accurate and keep it current. Do not impersonate another person, create an account for someone else without permission, or use an email address you do not control.

Keep your sign-in credentials and devices secure. Tell us promptly if you believe an account has been accessed without permission. We may suspend or close accounts that are used deceptively, unlawfully, abusively, or in a way that threatens the service or other people.

Agents are responsible for their profile, biography, rates, availability, skills, photos, resume information, and every other item they submit. You promise that you have the rights needed to submit and display that content and that it is not misleading, unlawful, infringing, defamatory, harassing, hateful, sexually exploitative, or unsafe.

You retain ownership of content you submit. You grant VelvetGig a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute that content as needed to operate, secure, improve, and promote the service. This license ends for content when it is deleted, except where retention is needed for legal, security, backup, or dispute-resolution purposes.

Public profile information may be viewed by anyone and may be indexed by search engines. Do not publish private contact details, sensitive personal information, or information you do not want publicly associated with your profile.

A client may submit a contact request using information they choose to provide. That request is sent to the selected agent so the parties can communicate directly. You are responsible for evaluating the other party, confirming identity and authority, agreeing on scope and payment, and complying with applicable laws.

VelvetGig does not guarantee that a profile, availability listing, rate, identity, qualification, message, or engagement is accurate, current, safe, lawful, or suitable. Use reasonable care before sharing information, meeting anyone, traveling, hiring, or paying money.

You may not use VelvetGig to harass, threaten, defraud, stalk, discriminate against, exploit, or harm another person; send spam or malicious code; scrape or harvest data; attempt unauthorized access; interfere with the service; publish unlawful or infringing content; misrepresent an engagement; or use the service for a purpose that violates these terms or applicable law.

We may modify, suspend, or discontinue all or part of VelvetGig at any time. We aim to keep the service useful and secure, but we do not promise uninterrupted, error-free, or permanently available operation. We may remove content or restrict access when reasonably necessary to enforce these terms, protect people, investigate abuse, or comply with law.

VelvetGig is provided on an "as available" and "as is" basis to the extent permitted by law. We disclaim warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the extent permitted by law, VelvetGig and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, business, or goodwill arising from your use of the service or any client-agent interaction. Nothing in these terms limits liability that cannot legally be limited.

To the extent permitted by law, you agree to defend and indemnify VelvetGig and its operators from claims, losses, liabilities, costs, and expenses arising from your content, your use of the service, your violation of these terms, or your dealings with another user.

You may stop using VelvetGig at any time. We may suspend or terminate access if you breach these terms or if doing so is needed for safety, security, legal compliance, or operation of the service. Terms that by their nature should survive termination will survive, including ownership, disclaimers, limits of liability, and indemnity.
